TERMS OF USE FOR THE AI-POWERED CHATBOT AMY

1. Operator and Purpose of Use
   The AI system AMY is operated by Amsety GmbH. AMY is designed to make digital conversations in the healthcare context more user-friendly and to support communication between you and your healthcare provider.
   AMY uses a domain-specific knowledge base tailored to healthcare topics. This knowledge base is curated and maintained by your provider and may include organization-specific content. The operator does not control or verify these contents.
   AMY is not a diagnostic or medical consultation tool and does not replace professional medical advice. For medical questions, diagnosis, or treatment decisions, please consult your healthcare professional directly.
   You may use AMY without entering personal data, except when using the chatbot to schedule an appointment. While it is technically possible to input sensitive information (e.g., health data or personal beliefs), doing so is explicitly prohibited. Do not enter confidential or sensitive information into the chat with AMY.
2. Permissible Use
   AMY may only be used for the purposes described above. Any unrelated or inappropriate use is strictly prohibited.
3. No Medical Advice or Liability
   AMY does not provide medical advice or make health-related recommendations. The responses generated by AMY do not constitute medical guidance, instructions, or a substitute for professional medical expertise.
   The operator does not assume responsibility for the accuracy, completeness, or relevance of AMY's responses. Use of AMY is at your own risk. Always consult your healthcare provider before making health-related decisions.
   AMY stores chat histories and makes them available to your provider for quality assurance and follow-up purposes. The use of AMY is free of charge.
4. External Links and Third-Party Content
   AMY’s responses may include links or references to external websites that are not monitored or controlled by the operator. We are not responsible for the content of third-party websites or the links they contain.
5. No Recommendations Under Financial or Legal Regulation
   AMY’s responses are not to be understood as medical product endorsements or formal health recommendations as defined by applicable EU or national medical regulations. AMY does not conduct suitability or appropriateness checks regarding any products or services that may be referenced.
   If AMY provides information about past or future health trends or outcomes, this information is based on general past data and is not a reliable indicator for individual future outcomes. Health-related decisions carry risks and should only be made in consultation with qualified professionals.
6. Liability
   Liability on the part of the operator is limited to intent and gross negligence, except in cases of injury to life, body, or health.

PRIVACY POLICY FOR THE AI-POWERED CHATBOT AMY

When using the digital AI health assistant AMY, personal data is processed.
Entering personal data into the free-text field (chat window) — especially health data, information about your origin, or other sensitive details — is strictly prohibited.
Please do not enter any personal or sensitive data into the chat with AMY.

2. Types of Data and Purposes of Processing
   1. Chat Content
      All text inputs you provide to the chatbot are processed by the controller to respond to your inquiries.
      The legal basis for this processing is Article 6(1)(b) GDPR (performance of a contract or pre-contractual measures), as the chatbot communication is necessary to handle your request.
      Chat histories (your inputs and the chatbot’s responses) are also stored for review and quality assurance by the controller.
      The legal basis for this is Article 6(4) in conjunction with Article 6(1)(f) GDPR.
      Our legitimate interest lies in ensuring and improving the quality of the chatbot’s responses and, where applicable, in preparing for personal consultations by reviewing previous chats.
   2. Metadata Related to Chatbot Usage
      We also store metadata related to your chatbot use (such as date and time) to link contact requests submitted before, during, or after chatbot use.
      The legal basis is Article 6(4) in conjunction with Article 6(1)(f) GDPR.
      The legitimate interest is to correctly associate user inquiries with specific chat sessions.
3. Data Retention Period
   Your personal data is only stored as long as necessary to fulfill the purposes of processing.
   Chat content and usage metadata are deleted three (3) months after collection, unless legal retention obligations exist, or storage is required for the establishment, exercise, or defense of legal claims.
4. Data Disclosure to Third Parties
   Your data is processed by Amsety GmbH, which operates the chatbot.
   We have signed a data processing agreement with this provider in accordance with Article 28 GDPR.
   The provider may also process chat histories to ensure and improve the chatbot’s quality.
   To provide technical services, user inputs may be transmitted via an API to Amazon Web Services (AWS).
   AWS processes this data on servers located in the European Union.
   AWS acts as a sub-processor solely to process and respond to your inquiries and does not use the data to improve AWS services.
5. Your Rights
   Regarding the processing of your personal data, you have the following rights:
